PRIVACY POLICY FOR JIOCHAT APPLICATION
Thank you for using JioChat! Your privacy is important to us. To
better protect your privacy we provide this Privacy Policy.
SCOPE

Jio Platforms Limited and/or its affiliates (hereinafter referred
to as "JPL", "Company", "we", "our", "us") is committed to
protecting the privacy of the users ("you", "your", "yourself",
"user") of its JioChat website and JioChat application offered by
the Company (hereinafter referred to as "JioChat") and has
provided this privacy policy ("Policy") which outlines JioChat's
privacy practices regarding the collection, use and safeguard of
your information through JioChat and the services offered
thereupon.

This Policy forms an integral part of the End User Licence
Agreement available at
("EULA")
and should be read in consonance with the EULA. Capitalised terms
which have been used here but are undefined shall have the same
meaning as attributed to them in the EULA.

By using the App or registering or signing up for the App and
submission of personal information or if you are a minor, the
submission of your personal information either by your parents (or
your guardian) or by you with the permission of your parents (or
guardian) to JioChat will be deemed as your acceptance of this
Policy.

This Policy shall be construed as provided in compliance with the
Information Technology Act, 2000, as amended from time to time,
and rules thereunder ("IT Act") and is published in accordance
with the provisions of Rule 3(1) of the Information Technology
(Intermediary Guidelines and Digital Media Ethics Code) Rules,
2021, as amended from time to time ("IT Intermediary Guidelines
Rules"), which requires the publishing of rules and regulations,
privacy policy and user agreement for access or usage of the App.
This Policy is also published in compliance with the Information
Technology (Reasonable Security Practices and Procedures and
Sensitive Personal Data or Information) Rules, 2011 ("SPDI
Rules"), as amended from time to time. This electronic record is
generated by a computer system and does not require any physical
or digital signatures.
CHANGES TO THE PRIVACY POLICY

We are obligated to protect your information in accordance with
applicable laws and regulations.

This Policy is subject to modification based on changes in the
business, legal and regulatory requirements and will be updated
online. We will notify you whenever any changes to the Policy are
made or periodically inform you of the Policy. You are encouraged
to periodically visit this page to review the Policy and any
changes to it.
THIRD PARTY SERVICES

Please note that your mobile service provider, mobile operating
system provider, third party applications (including the
applications pre-loaded on your smartphones powered by Android/iOS
platform or customised Android ROM or Jio Phone ("Device")),
social media platforms and websites that you access may also
collect, use and share information about you and your usage. We
cannot control how these third parties collect, use, share or
secure this information. For information about third-party privacy
practices, please consult their respective privacy policies.
PERSONAL INFORMATION WE COLLECT

Personal information is defined as information that can be used to
identify you and may include details such as your name, age,
gender, contact information, products and services you are
interested in or require more information about. Insofar as
sensitive personal information is concerned, it will carry the
meaning as may be defined by applicable laws from time to time.

The following is the manner in which we collect, use, share and
retain personal information:

2.1 Collection:

You agree that JioChat may collect such personal
information, whenever relevant, to help provide you with
information and to complete any transaction or provide any
product or service you have requested or authorised. You
also consent to the collection of certain personal
information in the course of your applying for the
products and/or services offered through JioChat.

2.2 Usage:
JioChat seeks this information either to:
-
(i) validate and process your request for the services of
JioChat or information;
- (ii) improve the quality of JioChat;
-
(iii) assist you to determine which services best meet
your needs;
-
(iv) facilitate our internal business operations,
including the fulfilment of any legal and regulatory
requirements;
-
(v) provide you with recommendations about services you
may be interested in, based on your use of JioChat;
-
(vi) provide you with marketing communications and
advertising that JioChat believes may be of interest to
you;
- (vii) facilitate your purchases; or
-
(viii) to the extent applicable, operate AI-based or
synthetic content features offered within JioChat, subject
to the consent obligations described in this Policy.

2.3 Sharing:

We may disclose personal information to our affiliates
when necessary to perform services on our behalf or on
your behalf, including to provide display advertising and
promotional services, providing search results and links
(including paid listings and links), processing credit
card payments, providing customer service etc.

We may also share personal information with external
organisations or individuals if we believe that access,
use, preservation or disclosure of the information is
reasonably necessary to:

i. 1: meet any applicable
law, regulation, legal process or enforceable
governmental request;
-
ii. 2: detect, prevent or
otherwise address fraud, security or technical issues;
and
-
iii. 3: protect against harm
to the rights, property or safety of our customers or
the public, as required or permitted by law.

2.4 Retention:
The information so collected shall be retained only for a
limited duration necessary to fulfil the purposes outlined
herein, unless a longer retention period is required or
permitted by law, and only for the purposes defined above.
Once the purpose is achieved, all personal information is
deleted in a safe and secure manner.
NON-PERSONAL INFORMATION

Non-personal information is defined as any data that does not
personally identify you and may include unique system or hardware
identifiers, system or application software, and peripherals.

Any non-personal information, when combined with personal
information, shall be treated as personal information. You may at
any time opt out of sharing the same.

The following is the manner in which we collect, use, share and
retain non-personal information.

3.1 Collection:
You agree that JioChat may collect diagnostic, technical and
usage-related information for the usage purposes described
below.

3.2 Usage:
The above-mentioned information is gathered periodically to
provide and improve JioChat and services therein, facilitate
the provision of software updates, product support and other
services to you (if any), and to verify compliance with the
terms of this Policy.

3.3 Sharing:
To enable JioChat partners and third-party developers to
improve their software, hardware and services designed for
use with JioChat, we may also provide any such partner or
third-party developer with a subset of diagnostic
information that is relevant to that partner's or
developer's software, hardware and/or services, as long as
the diagnostic information is in a form that does not
personally identify you.

3.4 Retention:
The information so collected shall be retained only for a
limited duration necessary to fulfil the purposes outlined
herein, unless a longer retention period is required or
permitted by law, and only for the purposes defined above.
Once the purpose is achieved, all information is deleted in
a safe and secure manner.
LOCATION SERVICES

JioChat, its licensees and agents, may access, collect and analyse
your usage of JioChat and other information related to your
location on a regular basis through Bluetooth and Wi-Fi signals
and other technologies and data, for the performance of the
services provided by JioChat and to help improve the design,
functionality, performance and content of JioChat. In order to
collect geo-location information, the location settings must be
enabled on your Device. Therefore, in some cases, JioChat may
request that you enable the location settings.

Except in cases where any specific services requested by you
require or involve personal identification, JioChat collects
location data anonymously and in a form that does not personally
identify you. By using JioChat, you agree and consent to the
transmission, collection, maintenance, processing and use of your
location data and queries to provide and improve such services of
JioChat.
COOKIES
-
Information collected by cookies and other technologies is treated
as non-personal information. However, to the extent that IP
addresses or similar identifiers are considered personal
information by applicable law, we treat any information linked to
such identifiers as personal information. Similarly, to the extent
that non-personal information is combined with personal
information, we will treat the combined information as personal
information.
OTHER INFORMATION JIOCHAT COLLECTS

JioChat may also collect other information about you in ways that
JioChat describes to you at the time of collection or otherwise
with your consent. You can choose not to provide us with certain
types of information, but doing so may affect your ability to
avail and/or use some services.

At the time of installation of JioChat, JioChat will require your
permission to enable it to find the location of your Device,
modify or delete SD card contents, read phone statistics and
identity, mount and un-mount file systems, etc. You acknowledge
that you agree to providing such information to JioChat for the
stated purposes.

The features of JioChat may allow you to post content such as
profile information, status updates, comments and other content
and/or information ("User Content"). The ownership over User
Content created by you remains with you; however, by sharing User
Content through JioChat, you agree to allow others to view and/or
share your User Content in accordance with this Policy. For the
purposes of this Policy, any reference to "information" in the
context of information being used to commit an unlawful act shall
be construed to include synthetically generated information. The
removal of, or disabling of access to, any information including
synthetically generated information by JioChat in compliance with
applicable rules shall not amount to a violation of the conditions
of Section 79 of the IT Act.

JioChat may enable you to invite your friends to use JioChat by
sending them an invitation email or message. You may do so by
using JioChat to send or post an invitation message to your
friend's external email address or their contact information. If
you send or post an invitation message, we may collect personal
information about the recipient such as their email address or
their third-party website account username.
SYNTHETICALLY GENERATED INFORMATION
For the purposes of this Policy:
-
"Audio, visual or audio-visual information" means any
audio, image, photograph, graphic, video, moving visual recording,
sound recording or any other audio, visual or audio-visual
content, with or without accompanying audio, whether created,
generated, modified or altered through any computer resource.
-
"Synthetically generated information" means audio, visual
or audio-visual information which is artificially or
algorithmically created, generated, modified or altered using a
computer resource, in a manner that such information appears to be
real, authentic or true and depicts or portrays any individual or
event in a manner that is, or is likely to be perceived as,
indistinguishable from a natural person or real-world event. The
following shall not be deemed to be synthetically generated
information:

routine or good-faith editing, formatting, enhancement,
technical correction, colour adjustment, noise reduction,
transcription or compression that does not materially alter,
distort or misrepresent the substance, context or meaning of
the underlying information;
-
the routine or good-faith creation, preparation, formatting,
presentation or design of documents, presentations, PDF files,
educational or training materials or research outputs,
including use of illustrative, hypothetical, draft,
template-based or conceptual content, where such creation does
not result in any false document or false electronic record;
or
-
the use of computer resources solely for improving
accessibility, clarity, quality, translation, description,
searchability or discoverability, without generating, altering
or manipulating any material part of the underlying
information.
JioChat's rules and regulations, privacy policy and user agreement
inform users of its computer resource not to host, display,
upload, modify, publish, transmit, store, update or share any
information, including any synthetically generated information,
that violates any law for the time being in force. In particular,
users shall not create, generate, modify, alter or disseminate any
synthetically generated information that:

contains child sexual exploitative and abuse material,
non-consensual intimate imagery or is obscene, pornographic,
paedophilic, invasive of another person's privacy including
bodily privacy, vulgar, indecent or sexually explicit;
-
results in the creation or alteration of any false document or
false electronic record;
-
relates to the preparation, development or procurement of
explosive material, arms or ammunition; or
-
falsely depicts or portrays a natural person or real-world
event in a manner likely to deceive.
Where JioChat offers a computer resource which enables, permits or
facilitates the creation, generation, modification, alteration,
publication, transmission, sharing or dissemination of
synthetically generated information, every such information that
is not unlawful shall be prominently labelled as synthetically
generated, and shall be embedded with permanent metadata or other
appropriate technical provenance mechanisms, including a unique
identifier, to identify the computer resource of JioChat used to
create, generate, modify or alter such information. JioChat shall
not enable the modification, suppression or removal of such label,
permanent metadata or unique identifier.
Users are hereby informed that directing, instructing or otherwise
causing the computer resource of JioChat for the creation,
generation, modification, alteration, publication, transmission,
sharing or dissemination of synthetically generated information in
contravention of applicable law may attract penalty or punishment
under the IT Act, the Bharatiya Nyaya Sanhita, 2023, the
Protection of Children from Sexual Offences Act, 2012, the
Representation of the People Act, 1951, the Indecent
Representation of Women (Prohibition) Act, 1986, the Sexual
Harassment of Women at Workplace (Prevention, Prohibition and
Redressal) Act, 2013, and the Immoral Traffic (Prevention) Act,
1956. Any such contravention may lead to:
-
the immediate disabling of access to or removal of such
information;
-
suspension or termination of the user account without
vitiating the evidence;
-
identification and disclosure of the identity of the violating
user to a complainant who is a victim of, or acting on behalf
of a victim of, such contravention; and
-
where the violation relates to the commission of a mandatorily
reportable offence, reporting of such offence to the
appropriate authority in accordance with applicable law.
THIRD PARTY APPLICATIONS, WEBSITES & SERVICES

JioChat may include links to other websites/applications or may
display advertisements from third parties and other content that
links to third-party websites. Such websites/applications are
governed by their respective privacy policies, which are outside
JioChat's control. Once you leave our servers, use of any
information you provide is governed by the privacy policy of the
operator of the website/application you are visiting. That policy
may differ from that of JioChat. If you cannot find the privacy
policy of any such website/application via a link from the
website's homepage, you should contact the relevant
website/application directly for more information.
ACCESS, CORRECTION AND DELETION

JioChat strives to keep its records updated and accurate with your
latest information. You shall be responsible for ensuring that the
information or data you provide from time to time is and shall be
correct, current and updated, and that you have all the rights,
permissions and consents to provide such information or data.

You may note that deletion of certain information or withdrawal of
consent may lead to cancellation of your access to JioChat or your
access to certain features and services of JioChat. Additionally,
we may not be able to process your request for correction,
updating or deletion in case the same is not supported by valid
documents, or data retention is required by applicable law or law
enforcement requests or under any judicial proceedings, or it is
extremely difficult to implement (such as requests related to
backup copies or if a new system is required to process the
request or a change of technical design is needed), or it risks
the privacy of other users. Where your biometric data, facial
image or voice data has been processed for the purpose of any
synthetic content feature and you subsequently withdraw consent or
request deletion, JioChat shall delete all underlying source data
and, to the extent technically feasible, disable or remove any
synthetic outputs generated from such data that remain on
JioChat's systems, subject to any legal retention obligation.

You acknowledge and agree that you may receive certain
notifications relating to the App on your Device or on your
registered contact details. At any given point of time, if you
decide not to receive notifications, you may turn off such
notifications through your Device settings or the App's
notification preferences.

We are committed to protecting your personal information collected
and processed by us and look forward to your continued support for
the same. In accordance with Rule 3(2) of the IT Intermediary
Guidelines Rules, JioChat has designated a Grievance Officer whose
name and contact details are published below. In case of any
feedback or concern regarding protection of your personal
information, any privacy-related feedback or concerns, or any
complaint against violation of the provisions of applicable rules or
any other matter pertaining to the computer resources made available
by JioChat, including complaints relating to synthetically generated
